URGENT ACTION NEEDED

MALAYSIA STOP WHIPPING, END CORPORAL PUNISHMENT FOR ALL OFFENCES

On the 20 July 2009, the Syariah High Court in the Malaysian state ofPahang sentenced Kartika Sari Dewi Shukarno, 32, to six strokes of thecane and fined her RM5,000 (approximately US$ 1,400) after she pleadedguilty to consuming beer two years ago at a hotel in Pahang. On 18August 2009 the same Shariah Court ordered that Kartika Sari DewiShukarno be remanded at the Kajang women’s prison in the state ofSelangor from Monday, 24 August 2009 and caned within seven days of this date.

To our knowledge, no person in Malaysia, male or female, has thus far beencaned under the country’s Shariah laws, making her the first to bepunished in this way. Furthermore Kartika will be the first woman to becaned in Malaysia as under the existing Malaysian Criminal ProcedureCode, only males are subjected to caning for a range of crimes.

Women’s Groups urges the government of Malaysia to review caning as a formof judicial punishment under the Common and Syariah legal systems. In thecase of Kartika, it constitutes further discrimination against Muslimwomen in Malaysia and violates Constitutional guarantees of equality andnon-discrimination as whipping of women under Shariah Criminal Offenceslegislation contradicts civil law where women are not punishable bycaning under Section 289 of the Criminal Procedure Code.

There is no consensus among Muslim scholars on the range of crimes forwhich whipping is prescribed, nor on whether women should be whipped. Noris whipping for consuming alcohol considered proportionate to the gravityof the offence.

Sisters In Islam (SIS) in their press statement on 23July 2009 have said:

“SIS believes that Islam as a religion of compassion calls people to theway of God with wisdom, as expressed in Surah An-Nahl,16:125 , “Inviteall to the way of the Lord with wisdom and beautiful preaching, andreason with them in the ways that are best and most gracious.”

“The goal of Islamic authorities is to prevent crime in the first place,not to inflict severe punishment as a first resort. Promoting andprotecting the human rights of the ummah, ensuring socio-economicjustice, educating the ummah about God’s teachings and laws in order thatthey become responsible for abiding by them out of faith are prerequisitesbefore any punishment can be implemented. SIS further added today “ThatKartika has expressed remorse should move the Malauysian authorities toemulate God’s attributes of compassion (rahmah) and mercy (rahim),especially within the holy month of Ramadhan”.

In conclusion, the women’s groups below reiterate that corporal punishmentwhether for men or women violates human rights principles, in particularthe right to be free from cruel, inhumane, degrading treatment orpunishment.

The Malaysian government should immediately revoke the sentence to caneKartika and abolish the practice of corporal punishment.

We are writing to you to express our concern that a Malaysian citizenKartika Sari Dewi Shukarno has been sentenced by the Syariah High Courtin the Malaysian state of Pahang to receive six (6) strokes of caning forconsuming alcohol.

黄洁冰,你没有错。

黄洁冰 --- 一个我很很多年前就认识的人权工作者。后来和她有频密的接触,是我成为全职社会工作者之后的事情。一位对人权工作、环保充满热忱的朋友,一位很关心身边的战友,让和她在一起的朋友很舒适的女人。偶尔会有点情绪化,但是绝对是一位有理想、有抱负,而且一直为马来西亚有更好的明天努力的人。

从一位人权工作者,到后来大选的时候上阵,最后胜利了 --- 并获得雪州行政议员。这一路走来,她比其他的人付出了更多的努力,比一些人更坚持自己一直相信的原则。

今天,从网路上看到关于她的“裸照”及一些私生活的照片被无情的公开,看到那前雪州大臣的鸟言鸟语。

在雪州行政议员黄洁冰裸照流传的风波爆发后,坊间开始流传一些手机短讯,要求黄洁冰引咎辞职;前雪州大臣莫哈末基尔更在第一时间站出来,呼吁黄洁冰向去年初爆发性爱光碟的马华署理总会长蔡细历看齐,应该立即辞职。

也是巫统雪州反对党领袖基尔接受《当今大马》询问时说,当初在蔡细历性爱光碟事件爆发后,民联领袖都纷纷敦促后者引咎辞职;如今同样事情发生在黄洁冰身上,民联不应该持有双重标准。

“这个是她的道德问题,以前蔡细历也是辞职。”
“若不辞职公正党没道德”他说,黄洁冰应该尽快辞职,以便还给公正党一个清白名誉。
“否则,它将是一个没有道德的政党。”

他说,公正党可能在308大选前,没有详细调查每名候选人的背景,因为民联根本没有想到本身将在雪州执政。

真不愧是toyo-toyo,也只有他才会如此大声的大讲鸟话。

我想说的 -- 如果连黄洁冰这样的背景都没有资格出来竞选,那么那些只靠金钱政治获得出战的国阵人,及一些为了凑数而出来的民联人,全部都可以不用出来了。

有男朋友,有私生活,有什么奇怪?只要两人两情相悦,是男女朋友关系,关起了房门,要做什么事情,难道还要知会选民?

而且,这是一起偷拍事件,是一个没有获得当事人的同意下获得的照片。

你们说不可能?有个马华的不知道什么东西说,一位未婚女子,会让一名男人踏入睡房,拍照你不知道?这种鸟话,亏他还是所谓的马华某个等级的人物。

我可以让一名我信认而且很要好的男性朋友踏进我的房间,在房间聊天 --- 如果我没有伴侣,我还可以和他一同打地铺看戏到天亮,甚至一同睡着。这是我的自由!

什么未婚女人不应该让男人进来房间 --- 这种论调居然会发生在这样的世纪。

现在的科技那么发达,尤其手机摄影,很多时候我们被拍了都不知道。

我们中心里,一年因为被偷拍、被强迫拍下亲热照片或裸照的女生,最后被无良男友、丈夫恐吓的案子,每一个月都几件。

被拍下照片的人不道德,还是偷拍照片拿去赚钱、得到利益的人不道德。

身为一位女性,要在以男人为主、游戏规则由男人来制定的政治圈子里,本来就不容易。最怕的是,你不知道什么时候会被你曾经信任过的人,因某种理由陷害,让我们的敌人用来对付我们。用恐惧、羞耻心来强迫我们退让。

被拍过裸照、与前任男朋友有过性行为,私生活比较多 -- 难道会比那些贪污、为了权力丧尽天良的人,来得可耻吗?

洁冰 -- 你没有错。错的是那个滥用了你的信任的人。你不无耻。无耻的是那个将这些照片发布出去的人。

你仍然是我当初认识的那个你,你仍然是尽责的行政议员、州议员。

你要坚持 --- 这一切会过去的。

记得 -- 你没有错。

Universal periodic review of Malaysia by the UN Human Rights Council

Malaysia's human rights record is coming under review by the Human Rights Council of the United Nations. This will be happening on Tuesday, 11 February 2009 in Geneva from 9.30 pm till 12.30 am.

Malaysia's review will be facilitated by 3 countries (the troika): Egypt, Qatar and Nicaragua.

During that review, the 3 main documents they will be referring to are:

1) the national report (prepared by the Government of Malaysia);

2) the UN agencies' report (a compilation report prepared by the UN based on their interaction with Malaysia through e.g. UNFPA, UNDP and the CEDAW Committee);

3) the stakeholders' report (a compilation of reports from 11 organisations that submitted reports to the Office of the High Commissioner of Human Rights (OHCHR) in September last year. From Malaysia, we have the main NGOs report - COMANGO's, then one from MWG-JUMP, JOAS and another from the Malaysian Bar. SUHAKAM submitted a report as well.

The Government of Malaysia is led by Tan Sri Rastam (Secretary-General of the Ministry of Foreign Affairs). His delegation includes 20+ people.

Let's watch - this is the first time we can see how our officials interact with the Human Rights Council.

Amongst the questions asked by states during this session, for which Malaysia is expected to give an answer, are:
  • Malaysia's use of the Internal Security Act (ISA) to arrest and detain critics of the government, including indefinite extensions of detention and degrading treatment of detainees during detention
  • Malaysia's measures to protect the rights of the children of detainees/ prisoners
  • Malaysia's selective application of the right to freedom of assembly to those who support government policies, while it denies permission, arrests and conducts harsh crackdowns on those who oppose government policies
  • Malaysia's measures to guarantee freedom of religion for all citizens, including the right to leave a faith, the right to a place of worship for all faiths, and the right of non-Sunni Muslims to worship
  • Malaysia's treatment of refugees, migrants and asylum seekers, in particular, their mass arrest, deportation, and detention in inhumane conditions; concerns are also raised about unwarranted violence by immigration officers and RELA during operations
  • Malaysia's criminalization of consensual sexual activity amongst people of the same sexMalaysia's treatment of street children
  • Malaysia's measures to address patriarchal attitudes and deep-rooted stereotypes about the roles and responsibilities of women
  • Malaysia's measures to protect the rights and prevent discrimination of indigenous peoples
  • Malaysia's steps to ensure that SUHAKAM is in compliance with the Paris

PrinciplesMalaysia's views on accession to core international human rights treaties

Within 48 hours after this session, a Working Group comprising selected states will write a Summary Report that list the issues raised and the recommendations made to Malaysia.

This report will be formally adopted at the next Human Rights Council Session in June 2009. Malaysia will then be responsible for implementing these recommendations.

Background

The UPR is a state-driven process under the auspices of the Human Rights Council, through which all 192 UN Member States are reviewed every four years. Through this process, the Human Rights Council reminds all states of their responsibility to respect and fulfill human rights obligations and commitments.

In examining Malaysia, the Human Rights Council will be considering:

  • A report submitted by the government of Malaysia, which is supposed to be drafted in broad consultation with stakeholders
  • A report compiled by the Office of the High Commissioner for Human Rights (OHCHR) summarizing information on human rights in Malaysia as collected through UN agencies and treaty bodies
  • A report summarizing submissions by SUHAKAM and civil society groups - including the Coalition of Malaysian NGOs in the UPR Process (COMANGO), Migration Working Group & the Northern Network for Migrant and Refugees (MWG-JUMP), Indigenous Peoples Network of Malaysia (JOAS), Bar Council of Malaysia, Amnesty International and Fédération Internationale des Ligues des Droits de l'Homme & SUARAM (FIDH-SUARAM)

我的启蒙老师艾琳斐南德斯无罪释放


第一次听到她的名字是1995年,当她将一份长长的阐述外劳在扣留营里遭到不人道对待的备忘录后,将扣留营黑幕公布于世的时候。接着,1996年她被逮,后来更援引《1984年印刷机与出版法令》第8A(2)条款控告她“蓄意发表不实消息”。

她是我对于人权课题的启蒙老师 -- 因为她,我认识到我们马来西亚执法单位的不公正。因为她,我认识到外劳、外来移民和我们一样都是人,都应该享有最基本的权益及照顾。

长长7年的审讯,2003年当法庭判她罪名成立,需做一年的监狱 -- 这的判决曾经伤透了很多积极参与社会运动,相信正义的人。

希望可以透过揭发事情的真相,捍卫这些弱势群体的朋友,最后因此而必需为她的正义坐牢。这是相信世间仍然存有正义的我无法理解的事情。

我在妇女援助中心工作的这些日子里,我时常有机会接触艾琳,即使我知道她和我的顶头大上司有点过节,但是我从不掩饰我对她的敬爱。

因为反贩卖人口的工作,我和她、她的妹妹常一同出席一些会议。从她的身上,我看到一位坚持捍卫身为一个人的基本权益而奋斗的勇士,散发的光芒。有几次,看到她拿着拐杖,慢慢、辛苦的走每一步路,但是仍然坚持的身影,我就很想拥抱她、很想哭。

能够认识您,和您共事 -- 我很感恩。恭喜您。

Why I defend migrant workers

“Migrants are human beings. They have the same rights as all of us,” so said Irene Fernandez when asked why she has dedicated her life to helping foreign workers whom Malaysians have invited into our country, and for some, into our homes.

They are here for the good life we have and we have a responsibility to protect them while they are in our country. We are accountable for what we do to them.

“Without them, we would not have the same economic growth we are enjoying today with the kind of cheap labour they are used for,” Fernandez told Malaysiakini in a one-hour interview at her office in Tenaganita. “Some of them go through the same kind of servitude and slavery that is supposedly banished from this country. If I’m in another country, I would expect the people there to protect me. If we cannot protect migrants, then we have no rights to have migrants here at all.”

But the Tenaganita director also drew parallels between the new migrant workers and those who have come to Malaysia from impoverished India and China in the last century.“It is very similar to how the British colonialists used migrant labour in the plantations as cheap labour. Today, we are reacting because as descendants of those migrants who were marginalised, we have that consciousness that we cannot remain marginalised.

“History is repeating itself. I am a product of that, I know what my parents went through. If we do not respond, our children will also suffer at the hands of the same oppressive government.”

The following is an abstract of the one-hour interview 24 hours after the High Court acquitted Fernandez, 64, of the charge of maliciously publishing false news on the conditions of immigration detention centres after a 13-year-long battle.In a memorandum released in 1995 entitled 'Abuse, Torture and Dehumanised Conditions of Migrant Workers in Detention Centres', Fernandez had alleged incidences of torture as well as deaths of undocumented migrants who were detained in the camps

How did you react when you were acquitted?

I didn’t believe that at that point yesterday (Monday) I would be set free and acquitted. I expected the trial to go on this whole week, and the judge would give his judgment, and that’s when things would be much clearer.

But when the prosecution (deputy public prosecutor Shamsul Sulaiman) stood up to say that ‘in order to ensure justice, we will not oppose the appeal’, I knew.

How did you feel?

I was surprised. I believed I’ve been right all this time and I believed I spoke the truth. What I didn’t quite believe in was the judicial system and how independent it is. So, it did come as a surprise.

My first reaction was I gasped, I covered my face and I cried, because 13 years is a very long time. It's been a 13-year struggle with a lot of restrictions. Therefore, it really was to say, 'I'm free'. There is excitement. There is hope. (But) the battle is not over.

The younger generations may not be aware of what exactly had led to the court case. Tell us about the controversial memorandum that you submitted to the government.

We all knew about the conditions in the immigration detention centres. You yourself (referring to Malaysiakini editor-in-chief Steven Gan) had done your own independent research and interviews and found that there were deaths in the (Semenyih detention) camp, and there were attempts to publish these findings in a special issue of The Sun. It didn’t see the light of day.

And so since Tenaganita had done interviews during its course of research on migration, health and HIV/AIDS and we had the information, we called a press conference, sent a memorandum to the government on the conditions, in this case, of the detention centres where these migrant workers were being held.

I had sent it (memorandum) to all relevant agencies and expected that at the least they would do their own investigations and hold accountable all the officers responsible for the torture and abuse and deaths in the camp.

What was in the memorandum?

It was horrific - horrific because there were deaths in the camps. We had migrants who said they had seen 20 deaths. They held the detainees in their arms as they died. There were abuses. There was denial of sufficient food and water. People died from beri-beri. There were at least 46 deaths.

When the government holds people under custody, you have to hold them responsible so that the lives are protected under that custody. So when people die from beri-beri - that is blatant torture and abuse. It’s like a planned or organised, premeditated murder. You see the guy shrinking, but there’s no access to treatment, and then he died. How can you just let go?

And beri-beri is considered a very easily treatable disease.

Exactly. It was a really, really serious issue. The torture, how people were abused, the conditions in the toilets that were blocked with excreta, the other contagious diseases. Migrants were wearing the same pants and shirt that they entered the camps with. Women had no sanitary napkins. Pregnant women could get no special care. It was really horrific.

Someone had described it as a ‘hell hole’.

I wrote that it was like concentration camps in peace times, which became one of the items in my charge sheet. It was an opinion (piece) that they had turned into a factual aspect for the charge sheet.

In March 18, 1996, I was arrested in my home and charged for publishing false news - not for criminal defamation under the Printing Presses and Publications Act. It came to be an issue of freedom of expression and the right of someone to raise the issue on behalf of the voiceless.

The intention (of the memorandum) was to inform the government in the hope that they would take action. But instead they took action against you?

Yes, to my surprise, when I returned from the Fourth World Conference on Women in Beijing, I discovered that the police were hunting for me. The Semenyih camp commandant had filed a criminal defamation report against me, and the police used that report to investigate me.

The other surprise was that when I did go for questioning, the police were not interested in the issues. They were interested in the people who gave the information. That’s when I thought I was not going to give them (the information), because they would then go for the migrant workers who gave information.

As a researcher, it was my responsibility to hold the confidentiality that I ensured them when they gave the interviews. In the end, I gave the names of three persons who did the interviews. Two were my staff, and one was a Bangladeshi social worker.

The issue of spreading false news under the printing law has always been used against journalists, and not so much NGO activists. Perhaps this was the first time that they used it against an NGO activist for ‘publishing’ a 30-page memorandum.

I think the government has found a way to criminalise anyone who brings up an issue. The act of ‘publication’ came in when I handed the memorandum to the journalist from the New Straits Times. The handing over was considered as publishing. The journalist was not charged - the one who wrote the article was charged.

In 1996, the government was willing to criminalise activists with the Printing Press and Publications Act and the Sedition Act.

What lessons did you learn from the ordeal?

Perseverance - it’s not to compromise on human rights at all, and that truth can prevail.

But the acquittal for me does not mean that the conditions at the detention camps have changed, and that is one major disappointment. It was on a technical matter that the appeal (was allowed).

In that context, it’s only a victory in terms of my freedom - but it’s not a victory in terms of the government’s accountability.

If it was on state accountability, then the conditions would change. But Tenaganita’s recent book ‘The Revolving Door’ revealed that the conditions in the detention camps have not changed.

The abuse, particularly sexual abuse, torture, is still very entrenched. Corruption still exists. The sale of refugees by enforcement agencies, also from the testimonies, is quite clear. That struggle will continue for us.

So despite the past 13 years, you don’t think the government has improved the conditions at the detention camps?

Not really. There have been very small efforts. Once, the Ministry of Health has made attempts to get doctors into the detention camps. Also, they’re not having the same people staying in the detention centres as many are removed to the prisons, they serve their time there, and then they are deported. So you do not have many staying in the detention centres (for years), which was among the causes for the deaths.

Then there was this effort to get the prison authorities to take over the detention centres. It looks as though it didn’t work because it has gone back to the immigration authorities together with (civilian volunteer corps) Rela - which is a major blunder because Rela men have no training and they do not know how to manage a detention facility.

We have taken a number of steps backward, rather than forward.

Are the deaths still occurring?

There are less reports of that. But all the other incidences - the abuses, the diseases, the torture - are still there.

DPP Shamsul said that the government’s decision to drop the appeal was made by attorney-general Abdul Gani Patail and suggested that you should thank him for it.

I’m not happy with that comment. The prosecutor revealed that it was the decision of the attorney-general not to oppose the appeal. That shows us where the powers are and that ultimately, it's the prosecution who decides and not the judge.

I think that's the problem in the system, in the judiciary. That's why I'm not very happy when it came to the acquittal. It didn't speak from the aspect of justice or what I stood for. It didn't punish the Printing Presses and Publications Act... You can see that the power behind (the justice system) is the attorney-general. That is worrying.

They’re saying you should be thankful to the government for not proceeding with the case.

Why should I be thankful to the government? I should not have been charged in the first place. The government went into a state of denial. It didn't take responsibility for what happened. No way would I be grateful to the government because I lost 13 years of my life for nothing.

Justice is not done simply because of my acquittal. Justice can only be done when remedies are made to what I stood for, the contents of the memorandum, to freedom of expression being upheld in this country, when human rights defenders are protected.

Only when all those things are increased, then there's meaning to the acquittal. It’s not a favour that I look for.

What restrictions did you face during the trial?

My passport was held by the court, and each time I seek to leave the country, I have to go back to the court and apply, I have to use the services of a lawyer to argue out the case and get my passport.

Once, to go to an FAO (Food and Agriculture Organisation) conference in Beijing, my application was rejected. I had to appeal to the High Court. They said I could go, but on conditions that I report to the Malaysian embassy when I arrived, and that I could not ‘tarnish the image of the nation’, whatever that meant. I had to come back and inform them of my return, and I had return the passport immediately.

My children grew up with their mother having to go to court so many days. There were 450 days of court trial, as well as the likelihood of one year in prison. It affected fundraising (for Tenaganita) because I was seen as criminal. I faced restrictions in traveling because I was categorised as a criminal.

I could not stand for elections, which denied my whole political career. Now, my age has caught up with me - I missed two elections because case dragged on.

Some would say that we have a lot of problems in Malaysia. Why should migrant workers be a cause for your concern? Why would you put your whole life into this particular issue?

Migrants are human beings. They have the same rights as all of us. They are here for the good life we have and we have a responsibility to protect them while they are in our country. We are accountable for what we do to them. Without them, we would not have the same economic growth we are enjoying today with the kind of cheap labour they are used for.

Some of them go through the same kind of servitude and slavery that is supposedly banished from this country. We cannot compromise on human rights. Human rights is universal and indivisible. If I’m in another country, I would expect the people there to protect me. If we cannot protect migrants, then we have no rights to have migrants here at all.

What do you advise the government and Malaysians who are treating migrant workers badly?

We want to enjoy everything cheap and we want to keep prices low, and so we are happy when that is done through forced labour - their passports are held by the employers, their work permits are not renewed, they cannot leave their place of work or else they would be arrested by Immigration enforcement personnel, or Rela - but that’s fine as long as our prices are low, as long as our economy is growing,

(Malaysians tolerate) human rights violations, and I think that is fundamentally wrong and that is wrong to have such consumption patterns.

Today, it’s the migrant workers. If we don’t make the government of the day accountable for what they do (to them) now, tomorrow it will be us. We are already seeing that happening in the kind of arrests being done, the kind of labour exploitation, how the government does not have a position when our own workers are being retrenched and displaced because we can get labour cheaply. That is what is happening today.

When we have a government that is not accountable, they will create conditions where we will not be able to ask for accountability. We create a system that is oppressive, repressive and where we find that we cannot question the government of the day, their authority and what they say is supreme. That is the sorry state of affairs if we do not take care of how migrants are treated.

It is very similar to how the British colonialists used migrant labour in the plantations as cheap labour. Today, we are reacting because as descendants of those migrants who were marginalised, we have that consciousness that we cannot remain marginalised.

History is repeating itself. I am a product of that, I know what my parents went through. If we do not respond, our children will also suffer at the hands of the same oppressive government.

What are your immediate political plans?

I’m a member of PKR supreme council but I want to be part of the whole change process, and if I have the opportunity, I want to stand for elections and be a representative of the people. It’s important that I have the opportunity to be a member of parliament, to be a voice for the communities that I have been working with.

I need to spend more time at the grassroots level, and in some of the communities I’ve been working with. I also want to contribute towards strengthening the framework for the understanding of human rights. In Pakatan (Rakyat)’s agenda, how do you develop a leadership that will articulate that framework as part of the agenda for change.

There are also issues that affect gender, the interpretation and understanding of religion and faith.

Some have noted that PKR itself, however, does not seem to have come out clearly on free trade agreements and the possible effects on migrant as well as local workers.

Very recently, there was an initiative to set up a parliamentary labour and human trafficking caucus. That is an indicator of our seriousness on the issues. Human trafficking as a form of labour has not been addressed effectively. All Pakatan Rakyat MPs need to be sensitised to these issues.

Furthermore, among the five things Pakatan has promised is minimum wage for all. We do not differentiate between locals and migrants. When the minimum wage is the same, there’s no dynamic of preferring foreign workers over locals.

The current government of the day has not moved very strongly into setting up and developing a comprehensive labour policy. That’s why there’s ad hocism in recruitment, labour. Pakatan has to come up with a labour policy.

However, I think we can be definitely stronger where the FTA (free trade agreement) is concerned. A clear policy hasn’t happened as yet. I agree that we do not have a very clear policy, but we are moving into that.

In hindsight, is there anything you would change?

Maybe strategy-wise. But continuing to voice out for communities, that would only be stronger.

Any regrets?

No regrets. In spite of it all, Tenaganita has grown in recognition, recognition has grown for our community work, and there is also global recognition for what we stood for. Positive developments have come out the court case.

13 years lost ... there's no room for gratitude

Migrant workers activist Irene Fernandez finds no reason to be grateful to Attorney-General Abdul Gani Patail for deciding against prolonging her 13-year court battle.

According to the 62-year-old mother of three, she should not have been charged in the first place for exposing the alleged human rights violations at immigration detention centres.

Instead of getting to the bottom of the allegations and rectifying them, she lamented that the government sought to punish her and other whistleblowers.

"Why should I be thankful to the government. I should not have been charged in the first place?" she said during an interview with Malaysiakini today."

The government went into a state of denial. It didn't take responsibility for what happened. No way would I be grateful to the government because I lost 13 years of my life for nothing," added the executive director of foreign workers' rights group, Tenaganita

Are you nuts? How can you detain a six years old child

Being a Malaysian is never easy.

Especially if you wish to be a Malaysian who perceived to be someone loyal to the country, only talk good things and praise the government of the country. When we are in overseas, we can stand tall with the cheek high up and tell people "I love my country! I am so proud to be a Malaysian!"

A six years old child was arrested when a group of them attempted to submit a letter at the Prime Minister Department's office at Putrajaya today.

P Vwaishhnnavi is the daughter of Hindraf chairperson P Waythamoorthy who is currently in self-imposed exile in London. Her mother K Shanti was also among those arrested.

Are you nuts? How can you detain a six years old child who her only hoped was to submit a letter to our beloved Prime Minister? How can a six years old child be a threat to our so call national security?

Please lah! Malaysian is a signatory country to the UN treaty the Child Rights Convention(CRC). This country is also a member in UN Human Rights Council who is among the least to get a three years term in this council. Don't you feel shameful to be one? Don't we feel shameful to be a Malaysian?

How can we then go to other country and tell people our country is doing good in every aspect and we love our country?

Therefore please do not condemn an activist / social worker like me and others who always sit in the international meeting and discuss all sort of issues that happened in Malaysia, and label us as "betrayer!" " Foreign agent!" "You damage the country image!"

Now Kuala Lumpur police chief Muhammad Sabtu Osman confirmed the arrest of eight men and three women during the incident. He clarified that Vwaishhnnavi has not been arrested and is in her mother’s care.

Alright. In her mother's care ... WHERE? her mother was among the 11 who arrested.

In her mother's care in the police station? police lock-up as her mother is there?

Abdul Taib Mahmud,我要求的并不多

作为一位全职的前线社会工作者;作为一个义务的辅导/精神健康工作者;作为一个号称上过很多心灵成长课程的“修心者” --- 很乱、很累。

寻找平衡多年的我,如今仍然在寻找着。虽然,老师一再的提醒我“对自己好一点”“我们没有教你如此修”,

但是我仍然希望自己的心情可以不要有那么大的起伏,面对弱势群体被不公平的对待,看到漏洞百出、一无四处的制度,面对他的时候,我没有办法完全没有情绪,有时候甚至会影响我一天。
以前,我做辅导义工的时候,我不会将我在接案的时候的情绪带回家。我在带工作坊的时候,即使有些参与者的故事让我很震撼,我们之前的互动让我很感动,偶尔我会想起这样的过程,但是对我的日常作息没有影响。当时候,我可以不但可以很客观的看问题,我也可以很客观的看待那些让他们受伤的朋友。

今天,当我和一位实习生在进行一个拯救的活动后,我们在医院有一段这样的对话。

她问我“你知道吗?当我看到一个又一个血淋淋的个案,有时候我走在大街上,我看到人群,我就会想他们会不会是其中一个被虐、被剥削的朋友,他们会不会是一个施虐、剥削他人的朋友,我就会很沮丧。你是如何可以那么坦然的去面对这一切?”

我告诉她“我不能,但是我会尽量”“针对那些施虐者,我会愿意去看到他们其实是更需要帮助的人,他们需要有人可以帮助他们看到他们自己的问题,让他们脱离这样的循环,只是可惜的是他们没有办法看到他们的需要-我就不会陷入憎恨他们的情绪里面”“对于那些剥削他人的人,我更不能接受的不是他们的个人,而是允许这样的剥削继续存在的制度。”

我的工作让我很靠近某一些群体,其中包括除了家庭暴力/性侵犯的当事人、外劳、难民、外籍女佣、被贩卖的当事人、以结婚为名被卖来马来西亚的外籍新娘 --- 现在还包括最近闹得很轰动的原住民。

面对我们不完善的救援制度,有时候坚持得很无力,支撑我的力量就是看到她们眼中对于未来仍然有一点希望的神采。

最近一连串棘手的个案,让我的情绪拉环锁得很紧,一触即发。

虽然,我一直很想写一篇关于“比南”原住民的文章。但是因为我知道我的情绪很差,我一直没有动笔。

晚上10点,我看到砂拉越的首席部长对于最近比南少女被性侵犯的报导,他说“停止对于砂拉越的一切谎言”http://www.malaysiakini.com/news/90932

我很愤怒,而且不是普通的愤怒。

我要求的不多,我只是希望我们可以公平的对待每一个人、认真的看待每一个投诉。当有一个这样的指责的时候,我们认真的去看待,去调查真相。

我第一次听到他们的故事是1996年,虽然陆续听到他们的故事,但是没有一次我与故事的主角是那么的靠近。可是,因为我与他们如此靠近,面对该首席部长这样的言论,我没有办法理解,更不能原谅。

如果不是因为情况已经恶劣得没有办法接受,缺乏支援的原住民朋友会冒险公开这样的事实吗?

逃避、将事情埋在地毯下不表示这样的事情没有发生 ---

如果他们是我们认识的人、亲人 --- 我们会让他们默默的忍受这样的痛苦吗?

身为首席部长,你的人民不是只有那些可以让你带来很大的好处的商家,更包括居住在你的州属里的每一个子民 ---

郭素沁被释放了之后,还会有人关心其他在内安法令下被扣留的朋友吗?

相对于以前,很多朋友对于内安法令都不甚了解、甚至不敢去讨论的年代,现在的情况其实让我很欣慰。

由于政府的愚昧,弄了一场记者、政治人物、有名的部落格被内安法令逮捕的“大戏”,让很多人都积极的讨论内安法令。即使是一些不问政事的阿叔阿嫂、阿公阿嘛,突然都在谈内安法令。
应该是一件好事,对吗?

素沁姐是我生命线前辈素彬的姐姐,由于前辈的关系认识了她,而且在2004年的大选曾经担任过她其中一个票箱的监票员。看到郭妈妈、郭爸爸在行动党总部的谈话,我很难过 -- 因此对于她能在9月19日被释放,其实我很开心。

当媒体记者被释放的时候,我曾经担心,会不会因为记者被释放了,我们就不会理其他仍然被内安法令扣留的其他人,媒体界的朋友会满足于云清被释放。

当素沁姐被释放的时候,我更担心了。我的担心是因为素沁被释放了,华社就因此而满足了,我们也不会再讨论内安法令这样的恶法的正当性。

带着这样的担心,我回家了。晚上的时候,我在Charles Hector的网站看到了一个他改编的诗。

and no one was bothered about the rest of those detained under the other laws that allow for detention without trial...

看了真的感触良多。

之前的联署有些争议,我在网上看了看一些网友的留言,亦可以认同一些朋友的看法。例如Haris Ibrahim就在他的部落格提到,他认识草拟联署的朋友(我亦知道他是谁),因此他相信支持内安法令不是草拟人的本意。亦有一些朋友提到,最重要的是我们要先施压,让他们释放政治犯。

而更重要的,我们需要了解其实除了内安法令,还有很多的恶法让执法单位可以未经审讯就将嫌疑犯扣留,包括紧急法令,包括用来对付所谓“外劳、无证件的外来移民的移民厅条例等等。

除了最新的3位朋友,原来在2008年7月的时候有六位朋友亦在内安法令下被扣留,而我们居然都不知道(可能有些朋友知道,但是对不起,我不知道)

废除恶法的呼唤声可以维持多久?没有人会知道 -- 毕竟我们的热血、我们的记忆是有保存期限的。这期限会是多久?没有人可以预测。

而我只能相信“希望” ---

对不起,我签署了“反对”内安法令的网上联署

昨天,有一个关于“反对”内安法令的网上联署正式推介,由于我从朋友哪儿知道草拟的人是谁,我很放心的在仅读了一小段就签署了,还成为第11个签署人。http://www.petitiononline.com/isa1234/petition.html

到了晚上,我从朋友哪儿发现我很欣赏的Charles Hector在马来西亚非政府组织的几个e-group发出了这样的呼吁,叫我们小心这个联署的内容,并要求我们不要联署,除非我们支持内安法令这样的恶法。

此联署的全文如下:

To: Prime Minister of Malaysia

We, citizens and friends of Malaysia from the international community, call upon Dato' Seri Abdullah bin Haji Ahmad Badawi, Prime Minister of Malaysia, to act immediately to set free Raja Petra Kamaruddin and Teresa Kok who are presently being held in detention without the right of due process under the Internal Security Act (ISA). We also call for the release of the HINDRAF Five and others presently imprisoned under the ISA.

The two latest detainees - together with Tan Hoon Cheng, a newspaper reporter who was subsequently released following widespread local outrage and protests - were arrested on September 12th under the draconian ISA which permits the police to detain a person for a maximum of 60 days for investigations. Based on the outcome of the investigations, a person can be detained for two years without trial. The two-year term can be renewed indefinitely. The use of such legislation – a legacy of British colonial rule - violates the basic rights of detainees to due process and fair rule of law.

We are of the opinion that there is no basis whatsoever to justify the detention of these individuals, despite the manner in which some in the government-controlled mainstream media may have painted them as threats instead of objectively reporting the facts. Raja Petra Kamaruddin is alleged to be a threat to security, peace and public order as a result of posting in his widely followed blogsite – www.Malaysia-Today – various articles deemed as seditious and belittling Islam. In his defence, it should be noted that various Islamic political parties and organizations (including the Board of Directors, Muslim Professionals Forum in their Press Release on 13 September) as well as numerous Muslim leaders have publicly refuted the Government's view that the writings of Raja Petra are in any way a threat to the nation or to Islam; and they have called for his release. Further proof that this allegation is unfounded can also be found in the decision of the Malaysian Cabinet on 12 September ordering the authorities responsible for Internet policing in the country to unblock public access to Raja Petra's website. The website currently is still unblocked and the so-called seditious and anti-national contents are publicly accessible, although Raja Petra is in detention. Targeting an internet blogger who holds views that differ from the Government is unacceptable in any system of democracy.

Teresa Kok's arrest under the ISA has been justified by the authorities as stemming from her involvement in activities which can cause tension and conflict among races and religions. This allegation appears to be based on a claim by the former Selangor Menteri Besar, Dr. Khir Toyo, that she organized a petition presented to mosque officials to lower the volume of the azan (call to prayer). Teresa Kok has categorically denied organizing any such petition. Abdul Rahman Nasir, head of the Masjid Kinrara committee (the mosque in question) and Dr Siti Mariah, Member of Parliament for Kota Raja where the mosque is situated, have also denied that Teresa Kok was involved in any such happening. The unjustified arrest of a respected member of parliament and state assemblywoman is unacceptable.

We are encouraged that various leaders of the Barisan Nasional (BN) coalition parties have recently spoken out against the use of the ISA. We wish to express our deep respect for the de facto Law Minister, Zaid Ibrahim, who has resigned in protest against the Government's use of the ISA on the three individuals. We agree with his view that "there [are] ample punitive laws to act against lawbreakers without having to invoke the ISA. [The law] should only be used on armed terrorists or those out to topple the government by force,"

We urge the Prime Minister to take note that the continued detention of Raja Petra Kamaruddin and Teresa Kok will only strengthen the view of Malaysians and many friends of Malaysia around the world that the Government is rapidly losing control over the political situation and, as a result, is embarking on desperate authoritarian measures. These measures can only further undermine political stability and confidence in the legitimacy of BN rule. They will also undoubtedly contribute to the increasing capital flight and worsen the growing socio-economic turmoil.

The arrests of Teresa Kok and Raja Petra Kamaruddin and their detention under the ISA are not serving Malaysia’s national interests. Both detainees – as well as the HINDRAF Five and other political detainees - should be released immediately and unconditionally.

虽然,我支持所有呼吁政府释放在内安法令下被扣留的“政治犯”的努力,但是我们不应该联署。因为在此声明,他表示内安法令是用来对付恐怖分子及意图用武力推翻政府的人士。这表示什么?这表示此法令有他存在的正当性,除非你赞成内安法令必须存在,否则我们不应该签署。

我很抱歉,我没有很仔细的看完该项声明就签署了。对于仍然在内安法令下被扣留的朋友和因此而饱受精神虐待的家属们,我对你们说对不起。

我坚持,内安法令这样的恶法不应该存在,无论你的理由是什么。如果当事人有罪,那么请你们将他提控上法庭,让他得到辩护的机会。我们不只要释放他们,我们要废除内安法令

否则,我就当你们这些警察、检控官是一群没有效率的笨蛋。因为你们不够专业,没有办法找到他们犯罪的证据而将他们控上法庭,因此你们用内安法令来将这些朋友无限期的扣留,这个法令变成让你们方便的一个工具(weapon of convinience)

同样的很多在紧急条例(Emergency Ordinance)下被扣留的各式各样的嫌疑犯,由于这个法令可以让你们扣留一个嫌疑犯长达两年(只要你们让他在不同区域的警察局环游世界),有很多这样的嫌疑犯没有办法取回他们的公道。

虽然我有一些当事人的施虐者曾经在这样的恶法被扣留,这样的扣留让她们得以让她们在短期可以喘一口气,不再受到威胁。我曾经因为很了解她们所受过的伤害而对于有这样的恶法来惩治施虐者而感到庆幸。

但是,到后来我比较了解“Human Right for All”真正的定义之后,我对于我曾经有过这样的想法感到羞耻。因为每个人,无论他犯下怎么样的错误,他都有权利要求到法庭为自己的控状辩护。因为有这样的条例,我们的检控单位可以拖延他们的调查,因为他们知道他们有的是时间,而不去想办法如何加速他们的调查,将嫌疑犯控上法庭。

是的,对不起。

最后,如果你们仍然选择签署,我相信你们有特定的理由,我尊重你们的决定。只是,请注意你们可能亦支持内安法令有其存在的正当性、必要性。

我失败了,因此我离开

终于,巫统的“良心”再益因为坚持自己的原则而选择了离开。

这几天,有太多的朋友在赞美他了,我就不再重复。

我只记得5月的时候,曾经因为一个活动去了国会一趟,当时候,我和我中心的ED在国会的餐厅喝茶的时候,刚好遇到了再益的其中一名女助理(记性不好,不记得她的名字了)。

我们一同喝茶,因为再益是我的ED的朋友,当年第十一条款联盟的论坛,还曾经邀请过再益。我的一些社运朋友说过,再益是我们的朋友。

我的ED问再益还好吧?那名女助理苦笑,说再益撑得很幸苦。当时再益在国会里提出了一些与巫统主流的议员不同的看法,有议员甚至呼吁革除再益的职位。再益自己亦表示,巫统有很多人希望他马上离开,但是他会坚持,他不知道能够做到什么时候,但是只要他在位一天,他会尽力。我的ED当时还对其助理说,要帮他啊,一定得坚持下去。

当天,在国会看到再益的时候,他还和我们队伍中一些认识的社运朋友谈了一下下。

仿佛才刚刚发生一样,转眼4个月过去了,而他真的离开了。

“我不是累,我只是失望”“我失败了,因此我离开”

对于一个很想为司法改革做些事情的他,说出这样的话,心情是落寞的,虽然支持他的人民很多。

对于曾经在朋友处听过很多关于再益的事情的我,对于这样的结局,是难过的。可是对于再益来说,也许是此时此刻唯一、最好的选者了。

When you said you have failed, what exactly have you failed in?
I have failed to convince those in authority to effect changes about how this government should move forward. I failed to convince them.
I believe in the basic principle that this country respects all rights and citizens. This country is for all, there is no room for discrimination, this country is about rule of law and transparency, these are the things that we need to change.
If you don’t subscribe to these principles or just pay lip service to them, it will be difficult to translate (these) into policies. This is my feeling.

You are adamant about resigning despite the prime minister rejecting it?
I am not adamant, I am just saying that I have made up my mind. I thank the prime minister for asking me to take leave but I have my point, I think it’s best I leave (resign).

Why are you giving up on your efforts to push for reforms?
This is not giving up, this is paving the way for transformation. In a way I hope (my decision) can wake up people and result in some changes, that’s my hope, to trigger some positive changes.

You’ve been brought in to the cabinet to introduce judiciary reforms, what is going to happen to that?
All these (questions) you have to ask after December (Umno party polls,). I don’t know, you have to ask the prime minister, maybe he will re-organise the cabinet and supreme council (line-up who) will be more supportive (of reforms). It depends on so many things, I can’t answer that.

Will judiciary reforms come to a stop with your resignation?
I don’t know, you will have to ask the new prime minister (smiles), or rather the prime minister.

Are you disappointed with Prime Minister Abdullah (Ahmad Badawi)?
He is a nice man. He has other things to deal with that I may not know (of). Remember he is the party president, I am just an ordinary guy, I don’t have to worry about other things, he may have other things to worry about, you have to ask him.

Did the prime minister support your reforms?
Within the constraints he got, yes, he was supportive but he got constraints.

Do you think the internal party conflicts are hindering his ability to be an effective prime minister?
I believe so. That’s why I feel that things will be better - for the government or the Barisan Nasional - after December.

Do you think if Opposition Leader Anwar Ibrahim forms government, you will have the support to initiate reforms?
I just hope that anyone who forms the government - be it Abdullah, Najib Abdul Razak, Tengku Razaleigh Hamzah, Muhyiddin Yassin or Anwar - I don’t care who - but I just want all those (things on) my wish list to be transformed. That is of course my hope, but as I said we have to see what happens first.

What's next for you - still with Umno or join PKR? It’s a very difficult question. The reforms I talk about, I got much criticism from Umno. Sometimes I think I should have changed (to be) like them instead of me trying to change them.
I do have some problems (in Umno) but at the same time I don’t know PKR well, I don’t know the leaders, so it’s too early to say but I have an open mind and I’m not in a hurry to make any decision.

Have you been courted by the opposition?
Courted? The last time I was courted was 30 years ago (laughs). No, but I have friends all over the place who call up but these are things happening to everybody.

But there is a rumour that you are joining PKR?
No, I have not made any decision of joining anybody. I am just saying that I have to do this. I hope it will trigger some good things, it will trigger some changes on the people in power, self-reflection and I hope the prime minister will overcome his challenges without the burden I carry (on him).

Are you going back to practice?
I don’t think so. I want to start a foundation to help build closer relations among the people in this country. I think race discrimination, prejudice and race relations are very bad. When I was young, I remember I thought we had much closer interracial (ties). Today we are a divided country.

Are you staying on as a senator?
Yes, because it will be nice to talk sometimes in the Senate to give my views on public issues. I love and care for this country very much like you all, I will do what I can. I believe this country is founded on very simple principles but very strong principles - fairness to all, justice, freedom, all those good things, I will work towards that.

What is the cause of the racial divide?
We have to do something to bring back trust and take action against some people who are bent on creating this division because of their own political agendas. We must overcome this.

You have been hailed as a hero and a man of principle?
I am not a hero, this is exaggeration. If I am a hero, I would have been successful in transforming this country. I just happen to say what I feel and do what I think is right.

What is the most important thing that the prime minister should do to bring some sort of changes?
The one single thing I think, is (for him) to trust the people in this country - all races. If you can’t bring yourself to that level of trust and acceptance, you will always worry if a particular policy will benefit this group or not. You worry whether you will upset certain benefits and privileges you have.
So long as you think sectarian or (along ) racial (lines), if you have too much thinking of that, it’s hard for you to have a policy that reaches out to everyone and applies to all. That psychological barrier has to be overcome.
We have to trust that we are one people and want to build one country and we want to have laws that apply to all.

In that sense, is it time for race-based parties to go?
I said before you can have race-based parties, you can fight for your community but you still can think of the country and common principles which bind us. You don’t have to be narrow-minded or cultivate the feeling of hatred, you have to do the opposite. These changes and reforms are for the country.

What do you have to say about your cabinet colleagues who have criticised you?
To my cabinet colleagues, I think some of them are very fine gentlemen. We have differences of views but there is no hard feelings, I hope to maintain that.

Before the Internal Security Act arrests, has it ever crossed your mind to resign?Yes, it has crossed my mind a couple of times, even in the early days (of my tenure).

When is your last day?
Looks like today (laughs).

朋友们,小心!


全世界为权力抓狂的政治集团、政府,都有那么一套让自己可以永恒的获得权力的法宝。就像一把上方宝剑,随时对准异议分子、人民一挥,马上立刻人头落地。

马来西亚这把上方宝剑的名字叫“内安法令”,还有其他的如“煽动法令”“官方机密法令”等。

2006约11月左右,我忘记当时发生了什么事情了,当时有几位朋友在聊天的时候说过,下一波的“茅草行动2” 矛头将会对准我们这一些常在国内外,羞辱马来西亚名誉的叛国份子。这几位朋友的语言一直没有发生,即使308后亦没有发生。

这个星期当巫统宣布阿末将冻结3年党籍的时候,他曾经说过其他的相关人士亦可能受到对付。忘记那位部长说,不排除会用内安法令。突然,Malaysia Today就解冻了。当时我告诉我弟弟,我猜他们解冻的之后就会动用内安法令对付他。我弟弟还说,不要傻啦,政府哪里有那么神经。
果然,内安法令一出,一砍就是3个人。

继政治部落客拉惹柏特拉之后,警方再次援引《1960年内部安全法令》第73(1)条款扣留了报道“华人寄居论”的《星洲日报》驻槟城高级记者陈云清及民联雪兰莪州资深行政议员郭素沁!截至临晨12时为止,三个“危害国家安全”人被警方以《内安法令》逮捕。《内安法令》第73条,任何被怀疑危害国家安全的人,不需要有逮捕令,都可以被警方扣留60天;再者,根据第8条款,经內政部长授权,可以继续扣留两年,且可以一再延长,也不需要经过任何法院审讯。

这个宝剑真的太好用了。

生气?愤怒?可能有些在某公开论坛常大搞种族主义的朋友(因为气死了),已经开始破口大骂某个民族,或者开始摆弄情绪“为什么阿末没有被抓,我们华人要站起来”。

我希望我的朋友们不要用愤怒来应对恐惧。

我们要认清楚。当权者会如此做是因为他们怕得要死,他们担心他们的党选、他们担心他们的中央政权。即使是突然呛声的国阵其他的成员党,他们会如此是因为他们也要党选了,他们需要党代表的选票。

我们要拒绝陷入在他们这些政治人物的纠纷,变成他们巩固自己的势力的工具。我们不要用愤怒来应对他们的招式,与他们一同共舞。

我们可以表达我们的不满,但是我们必须选对方式,避免落入这些政客所设定好的剧本。

什么剧本?

第一幕 他们用“内安法令”抓特定的人(已经上映)
这样的会让我们的人民愤怒非常。而各无论民联议员、国阵的成员党会开始硬起来。我们人民的情绪会受到鼓舞,会酝酿更剧烈的言论及情绪。
已经开始在北部酝酿了,听说哪的朋友非常激动。
很幸运,现在已经不是60-70年代了,有些有影响力的部落格、非政府组织、议员等开始呼吁人民冷静,千万不要掉入陷阱

第二幕 他们开始警告各大报章(已经上映)
这样我们的报章就会开始消声,然后人民将获得有限的资讯。资讯的有限会让我们陷入恐慌,而恐慌的时候我们会失去客观思考的能力。
这个重要,因为连我几个从来不过问政治,只管风花雪月、吃喝玩乐的朋友昨天都会对我说,听说会有暴动,开始知道“寄居论”

第三幕 阿末全国演讲
记得在记者会上,阿末说过他要到全国演讲,以团结马来同胞、捍卫回教吗?这个重要。因为这样的演讲必定会引发更大的种族言论。以我们目前所谓政客以捞政治资本为目的的年代,他们会用更激烈的方式来回应。
这样的剧情很熟悉的,不是吗?

第四幕 火红的年代
酝酿已久的情绪终于引爆,政府开始用内安法令逮捕更多的人民。情绪开始失去控制。政府的一些有专门任务的“地下组织”开始启动,Taman Medah的事件再度在各地上演。

第五幕 马来西亚宣布紧急状态

我们不要调入这样的剧本,参与编剧成为剧中的一份子。可能很困难,但是我们必须冷静的,不让自己陷入情绪里面。

移民厅需要承诺不Rajeshvari 的事件不会发生

上个星期,在Charles Hector的网站发现了一个惊人的新闻。

一名22岁,当时怀孕6个月的印度妇女,于2007年10月在吉隆坡15碑的一间咖啡厅等候亲友的时候被警察问话,最后因为没有办法出示身份证及不记得身份证的号码,不能讲流利的马来语而被误会为斯里兰卡的无证件移民,而被送进移民厅扣留营,在哪住到上个星期,她的孩子在扣留营出生。

Suhakam slams cops over 'mistaken identity' case

The Human Rights Commission of Malaysia (Suhakam) today took the police to task over the way it handled the case of a 22-year-old Malaysian suspected of being an illegal immigrant.

Suhakam commissioner N Siva Subramaniam said M Rajeshvari should have been given the time to explain herself.

He also criticised the police on the way it handles cases relating to illegal immigrants, saying that the police should listen to what these people have to say and not just 'tangkap muat' them.

Siva was responding to a report in the Star yesterday which stated that Rajeshvari was held at the Lenggeng immigration depot for nine months for not having proper identification and for failing to recollect her identity card number.

She was arrested during a police raid at a coffee shop in Kuala Lumpur last October. Since she was not fluent in Bahasa Malaysia, the authorities suspected her of being a Sri Lankan.
She was then sent to the Kajang prison for two months before being transferred to the immigration depot.

Rajeshvari, who was six months pregnant at the time of her arrest, later gave birth to a boy while in detention.

She was finally released last Friday following the intervention of an non-governmental organisation, the Malaysian Indian Youth council.

According to Siva, the police should have given her at least a few days to explain herself.
"She might have forgotten (her IC number) especially when she was forced to do so (during the raid)," he told a press conference at the Suhakam headquarters in Kuala Lumpur.

The commissioner said the police suspected that Rajeshvari was a Sri Lankan when she also failed to clarify her house address as she was staying in a squatter area where no house numbers are available.

"She had told the police and the National Registration Department (JPN) where she lived, but they insisted that she was a Sri Lankan. This shows that if your house is only a few kilometres away, they would still come and arrest you.

"If she (Rajeshvari) was not found by the NGO, she might have been deported (to Sri Lanka)," he added.

Not the first case

Meanwhile, the commissioner also stated that Rajeshvari’s case was not the first one, as there have been several mistaken identity cases in the country.

Having visited two immigrant depots in Menggatal and Sandakan in Sabah last week, Siva said there was a detainee who claimed to be Malaysian and owned an IC but was arrested by the authorities without any further investigation.

He said children between 12 and 17 years of age were also detained for failing to show their identification documents.

"They claimed they were born in Sabah and their parents were Malaysians. Despite all that, they were still arrested," said Siva.

Calling for a more strict system to be imposed to identify illegal immigrants, Siva said ‘thumb print identification’ could always come in handy.

"If the IC number cannot be used at that particular time, using the thumb print for identification could always work. Why isn’t the system working now?" he asked.

Siva also noted that magistrates were not fully educated in handling such cases.

"These (alleged) illegal immigrants should have been at least granted bail to provide their documents, say for a month or a week, not after eleven months," he said.

Siva said Suhakam will submit its findings to the police, NRD and the Immigration Department.
"We intend to speak to these agencies and they must come up with an assurance that we will not face the same situation anymore," he added.

虽然这样的事情不是第一次发生了,我仍然很生气到不行。尤其是当我可以近距离的接触当事人的时候。

我们看一看她被扣留的原因。

1. 没有携带自己的身份证
我有时候出门也未必会带身份证,尤其我去跑步、买饭吃。那么我会否因为我貌似中国、台湾、缅甸shan族的人,被一些没有脑的执法人员将我带去扣留营?

2. 不记得自己的身份证号码
我是很笨蛋的人。在还没有找到记得号码的窍门之前,我怎么样也没有办法记得那么长的号码。是啊,14个号码是非常的吓人的也。不记得号码就可以否决你的公民身份吗?这是什么奇怪的理由。

3. 不能说流利的马来文
让我们正视一件事情。对于很多在estate居住的印度朋友,不能说流利的马来文是很正常的一件事情。尤其很多这样的朋友连上学校的机会都没有。这是犯法的吗?刑事法典有哪一个条文说,我们一定要说流利的马来文,不然可以当作无证件移民来处理?
找一个能说印度文的翻译员,难道那么难吗?

没有办法证明Rajshvari的身份?即使她已经被扣留那么就?那么为什么Andrew可以?

It is baffling that a non-governmental organisation took only one day to verify that a suspected illegal immigrant was Malaysian when the arresting authority could not.

“They had her for a total of 11 months and they were unable to verify her claim that Rajeshvary Murugiah was a Malaysian.

“Unlike them, Andrew (Raju of the Malaysian Indian Youth Coun­cil) who met her at the clinic after she fell ill was able to confirm she was Malaysian by going to the Re­gistration Department,” said Su­­hakam commissioner Datuk N. 这是态度的问题,是移民厅官员、RELA、警察那种“与我无关”的态度问题。对于他们,是否抓错人不重要、扣留营人满为患不重要,重要的是他们能够获得很好的“业绩”。

移民厅的执法单位的总监说了这样的一段话

However, Immigration Department enforcement chief Datuk Ishak Mohamed said that the burden of proof of citizenship was on the person suspected of being an illegal immigrant.

“The new Criminal Procedure Code also allows the suspect to make phone calls to anyone who can help,” he said, pointing out that the police had picked her up, not Immigration officials.

“But, please, don’t tell me that after 22 years, you cannot speak Bahasa Malaysia? You mean she would not know how to sing Negaraku either?” he added. - Star, 8/9/2008- Suhakam raps Immigration

拜托啦。不是人家不会说马来文,而是她说什么那些官员都不听、不理会,更不用说想其他的办法来鉴定她的身份了。

Charles Hector 很不屑的在其网站这样批评这位总监

So, what is he saying here? If I cannot speak Bahasa Malaysia - then I am presumed not to be a Malaysian. Hello, there are many Malaysians who are not able to speak Bahasa Melayu... (In any event, Rajeshwari did communicate in Bahasa Melayu - but they did not care - they did not believe her... You should have checked ...investigated... It is sad also that the Immigration guy is now allegedly trying to shift the blame...

When did being able to sing the Negaraku a proof of being a Malaysian citizen? Was Rajeshwari even asked to sing the national anthem? He is just talking non-sense. Wonder whether this Ishak Mohamad can sing the Negaraku - and we should maybe just detain him if he cannot sing it right. Absurd comment by a Malaysian public officer. Embarassing further because that man is the 'enforcement chief'.

我们的移民厅扣留营还有多少这样的冤案?那些被扣留的公民、永久公民、难民、外籍劳工等。

如果我们移民厅执法单位总监可以说出这样的话,我们有理由相信有很多这样的朋友在我们的扣留所里面,在等待有一天,他们会遇到好像Andrew和Raju这样的天使。

我们的内政部部长必须要确保这样的事件不会再发生,我们的执法官员必须获得更完善的训练,让他们学习在执法的过程中如何更像“一个人”。

拥有到扣留营去检查他们的操作的人权委员会,必须确保里面这样的冤案,全被无条件的释放。扣留营不能再有小婴孩、小孩子、临盆的妇女。

我亦呼吁那些忙着夺权、组织新政府的民联国会议员关注这样的案子,而不是忙着夺权、而忘记捍卫弱势族群的义务。

我突然很感激一位警察。

同样的例子,同样没有证件、无法沟通。在扣留了那名女孩14天后(虽然我很不满),他没有因为省事将她送到移民厅的扣留营。他联络了我们,希望我们中心可以收留她,帮她做辅导,让她可以在比较放心的情况下说出到底发生了什么事情。他觉得可能女孩被吓坏了,他们亦不知道如何帮助她,因此寻求我们的帮助。

感谢他,没有将女孩被送到扣留营,然后经历遣送到边界,再被贩卖到马来西亚这样的过程。

很明显,不是吗?是执法人员的态度问题。如果移民厅的官员、其他执法官员可以比较人性、更有创意的寻找方法来辨识所谓的“可疑人事”,Rajeshvari的事件是不可能发生的。

需要4名男性证人证明被鸡奸

昨天,我看到安华通过回教法庭“反告”Shaiful的消息,如果Shaiful没有办法找到4名男性证人证明安华鸡奸他,他可以被罚款甚至监禁。

安华表示,许多宗教司劝告他勿通过向《可兰经》发誓的方式,来证明本身的清白。反之他们劝告他,应诉诸回教法律来举报赛夫诬告,以洗脱鸡奸案的指控。“在宗教司与律师的劝告下,我向回教法庭执法组投报,以便洗脱我与家人所受到的恶意诽谤。我受到劝告,根据回教法律的诬告条文作出投报,所以我促请执法组尽快查个水落石出。”

安华的律师卡玛爱妮雅(Kamar Ainiah Kamaruzaman)指出,根据1997年联邦直辖区刑事法典第41条文(Qazaf),如果赛夫无法提出4名男性证人,以证明本身曾遭到安华鸡奸,将可以在诬告他人通奸罪名下,被罚款5千令吉或监禁不超过3年。http://www.malaysiakini.com/news/85807

我很生气,生气到不行。我告诉我的男朋友(曾经是一名工程师,但因为相信此刻是政治改革的契机而变成一名民联国会议员的特别助理),你们这些人哪里可以让安华如此乱来,你知道开了这样的先例会造成毁灭性的连锁反应和后果吗?我连珠炮的骂了差不多一个小时,我生气到没有办法睡觉。可怜的他,就听我骂 -- 我甚至连他也骂。

1999年回教党夺取登嘉楼的政权的时候,他们在州议会通过了回教刑事法,其中最让很多组织反对的是通奸及强奸的部分。在回教刑事法,两个成年人,如果不是夫妻,就算是自愿发生性行为,也会被判死刑。一名妇女如果不幸被强奸,如果她不能提出4名有诚信的男性证人,回教法庭是不能把强奸者定罪。反之,受害者还可能被判诬告。

当然,他们有很多的理由来说明为什么这样的方式比较公平,公平的对待嫌疑犯及受害者。

他们说这是避免当事人因为报复或者是其他的理由,诬告他人强奸她(cried rape)。

但是,我们都必需认清一个事实,要让被强奸的当事人报警说自己遭遇强奸,这不是一个容易的过程。过程中的艰辛,当事人说承受的压力,是我们无法想象的。就因为这样,有人不愿意去报案;更因为过程中,当事人被不合理的对待及要求、被标签,因此很多朋友最后选择了放弃。如果不是因为真的发生这样的事情,他们只想讨回他们应有的公道,没有多少人愿意去经历这样的过程,而纷纷选者在黑暗里哭泣,尤其如果这是约会强暴的个案。

我们的刑事法典,我们的审讯的过程,已经没有办法很好的保护我们的当事人了。

如今,安华到回教法庭,以回教刑事法典的条文反告Shaiful,教育了我们社会什么东西?

首先,我必须先声明。我是认为对于安华的指责,是充满疑点的,我的心理不相信他会如此做,我也认为这样的指责是有其政治目的的。

可是,这并不表示我们可以因此而不先对这样的指责采取"Benefit of doubt"的态度。不管我们喜不喜欢,当有人报案说被人强制行进行肛交的行为,他是有这个权利去报案,而警方就有义务去将这件事情调查清楚,即使那个人是安华、即使我们大部分的人都不相信这样的指责。

我们可以大声的说我们的警察不中立,整个司法系统都不可能保护安华再度被诬赖。可是我们不能否定做为一个《受害的当事人》,Shaiful报案了之后,他就有权力要求警方调查。在此同时,我们必须永远保持安华有"innocent until proven guilty"的权利。

这是我们相信人权、司法的朋友应该有的基本态度。至少,我是如此相信的,虽然有些因为太相信民联可以让人民带来更好的明天的朋友,不太可以接受我这样的看法,而其中还包括我的战友,虽然他们可能说得很含蓄。

回到安华这样的一个举动,这样的先例会为我们带来什么后果 -- 让我们一起想象一下。

首先,他在被刑事法典377条文下被调查过后,然后通过联邦直辖区的刑事法典的条文,在回教法庭反告shaiful。我很有兴趣想知道,我们的回教法庭一般是处理宗教、家庭、财产分配等事务。可能我比较孤陋寡闻,活到那么老,我还没有听过我们的回教法庭有引用过刑事法典来审理关于强奸、鸡奸等案件,这一些都是由一般法庭审理的。这样的举动表示什么?表示我们认同用回教刑事法典吗?我们赞同用回教法来审理我们的刑事案吗?民联的国、州议员们和支持者,你们必须在这个议题上表达你们的立场!我是支持壮大反对党的,我的立场是我无法接受!那么,你们呢?

再来,这样的先例会造成什么后果?什么混乱?如果嫌犯在刑事法典下被控,然后又将此案带去回教法庭告当事人诬告,那么如果两方有不一样的判决,我们应该如何是好?他们会不会在此例子打开之后,就说强暴案可以由回教法庭来审理,因为比较公平? 而且我们要记得,在法律上的的先例,法庭的判决将成为precedent以后可以成为法庭判案的时候参考的依据,以后会变成怎么样?

以上是我关心,但不是我最担心的课题。你们知道我最担心的是什么吗?-- 我们再来想象一下。
如果,受尽伤害的当事人将此事告上警察局,可是对方是很有钱、有势力的人,甚至没有人相信对方需要强迫当事人发生性行为。这些人学安华,告到回教法庭去。这才是我担心的。

不要说这只是回教徒的问题,这是“人”“保护当事人”的问题!!那些因为讨厌国阵,结果对于民联说犯下的一些失误仍然处处维护的朋友,不要一直向我解释为什么安华做得对。

我关心的是,这些受尽创伤的当事人,她们会因此再度被伤害。本来被强暴已经是很受创的事情,她们居然必须到回教法庭去讲这些事情重新的说一遍,而且需要提出4个有诚信的男性证人,否则她会被判诬告。我们要让这些应经受尽折磨的人情何以堪呢?

我们如何可以允许这样的事情发生?
请一直盲目的支持民联的朋友说服我,为什么我不能生气!!

坦克车驶入市区

最近发生了一连串的大事,有如连续剧高潮一波接一波,让我眼花缭乱,身心疲惫。

今天请假,因为身体不舒服,睡了整天。醒来的时候,我在网上发现了一个这样的新闻

慕沙指军警皆有维公职责根据今日的《每日新闻》报导,大马皇家警察不排除与大马国防卫队合作,以控制示威游行、非法集会或任何足以干扰公共安宁的活动。大马皇家警察昨天与大马国防卫队展开首次维持公共安宁的联合演习。这项演习为期一周,参与者包括首都附近和雪兰莪州的警察部队,包括联邦后备队,以及驻扎在吉隆坡的国防卫队。全国总警长慕沙哈山表示,根据两年前与国防卫队的协议,警方可以在有需要的情况下,请求军队的协助以维持公共安宁。

在昨天的“警队与大马国防卫队联合演习”开幕礼上,慕沙哈山指控特定的政党、非政府组织和个人最近已经给公共安宁带来了威胁,它成为安全部队的一大挑战。“我认为,维持公众安全和公共安宁是所有安全部队的职责。所以,我们必须合作并协调起来,以便展开一致和迅速行动。”

这样的变动,再加上最近的进展,难免让人怀疑这样的演习其实是让军队及警方为马来西亚可能宣布紧急状态的彩排。

如果马来西亚真的必需出动“坦克车”来控制所谓的政党、非政府组织及个人所召开的和平集会,那么真的证明了Malaysia Boleh!我们的军队是保护国家安全的。什么时候,我们这些手无寸铁的人民,所召开的集会,居然严重的需要军队来维持持续?

朋友们说,这是前所未有的一项演习(据他们说,以前的演习都在其他的地方,这次来到吉隆坡,是很奇怪的),而出动军队来维持一个集会的持续,更应该被制止、被谴责!

想象一下,如果这样的局面是因为某些利益集团为了保护他们的政权,趁机制造机会宣布紧急状态,让我们变成“军人统治”的政府(我没有用错字眼吧?虽然不太可能)

再想象一下,我们熟悉的市区道路,出现了一辆辆装满军人的车子,甚至是坦克车 ---

投票人权,支持政改! -- 2008年大选之人权诉求

我国的先辈在经历了艰难的抗争后,终于1957年争取了大马的独立以让所有人民不分种族和宗教,可以在这片土地上有尊严地安居乐业,免于恐惧和免于贫穷和饥饿。

可是遗憾地,在国阵的管理下,大马独立50年后的今天,我国的人权情况却每况愈下,尤其是我国先贤在殖民地时期反抗英国殖民政府时所实践的媒体自由、言论自由、集会自由和结社自由,却在独立后一点一滴地在人民之间消失。这无疑对我国达到独立50年的今天是个天大的讽刺。

在这来临的大选,是时候人民争取回我们应有的权利、自由和这个国家的主权。

1.拒绝种族政治和种族主义

国阵所实行的种族政治不仅没有团结我国的多元民族,事实上它是在不断分化了我国的人民。人权的侵害、权力的滥用、国库的管理不当和政府贪污等种种问题都在种族政策下获得庇护。任何人若挑战朋党、贪污或裙带关系等课题,都会被指控为挑起种族紧张情绪或威胁国家安全。在内安法令(ISA)的淫威和513种族冲突阴影的恐吓之下,人民渐渐地被剥夺了所有权利。

因此,我们呼吁所有选民拒绝投票诉诸种族与宗教极端主义的候选人和政党。我们要求通过种族关系法令和成立种族关系委员会以杜绝种族主义和煽动种族仇恨的情绪。

2.废除所有相关的紧急法案和无审讯扣留

尽管我国人民在过去三个世纪都过着安宁的生活,并免于任何的战争或冲突,然而政府之前宣布的紧急法令和反颠覆法令却一直奉行到今天。这些法令赋予政府极大的权力,以致剥夺人民的公民和政治权利。这些紧急法案已被执政党滥用。

因此,我们呼吁在1964, 1966,1969和1977年所宣布的紧急状态必须在来届国会中正式撤消。我们要求所有的紧急法令反、颠覆法令及相关政策,必须立即=废除,尤其是赋予政府可以在无审讯情况下无限期拘留权力的1960年内安法令(ISA)、1969年紧急(公共秩序和犯罪防范)法令和1984年危险毒品(特别防范措施)法令。我们要求立即释放或在法庭上控告这些法令下被拘留的人。

3.尊重言论自由、集会自由和结社自由

言论自由、集会自由和结社自由是人民参与决策的基本权利。然而这些权利却常常在国家安全的理由之下被严重限制,虽然事实上这些打压明显是为了避免人民提出类似贪污、滥权国家政策失当等合理质疑和批评。

我们要求废除煽动法令和立法保护揭弊案者以捍卫言论自由。集会自由和结社自由应被允许通畅的实践,免于官僚主义的繁琐牵绊。有关当局的在这方面的决定必须可以被司法检查。我们要求废除警察法令要求所有集会必须获得警察准证的第27条文。

4.成立独立投诉及监督警察滥权委员会

近年来急剧上升的犯罪案再再显示了大马皇家警察的失职。更糟糕的是,警队已沦为当权者高压政治及政治暴力的工具。人民的权利遭到践踏。一个高效打击犯罪及同时在执法时尊重人权和保持政治中立、并免于任何贪污的专业警队,只有在一个独立的监督系统下才可能形在。

因此,我们要求执行由改革警察皇家委员会所提出的125项建议,尤其是成立独立投诉及监督警察滥权委员会这项建议(IPCMC)。

5.杜绝贪污

贪污在我国已经泛滥成灾,唯在执政者的威权下,这些课题都被扫进地毯底下而未被严格挑战。大型计划都授予与执政者有密切联系的个人或公司。在这个过程中,计划的费用成倍高涨及形成庞大且无谓的社会成本,浪费公款。纳税人被逼付出双重代价,即纳税钱被偷龙转凤承担贪污费用以及背负随之而来的高涨生活费。

因此,我们要求所有部长及高官在上任前公告其资产。所有生活奢侈而和其收入不符的部长及政府官员,必须严格调查及控上法庭。我们也要求反贪污局脱离首相署成为独立的机构,并只向国会负责和报告。

6.维护司法独立

近期闹得沸沸扬扬的林甘影片丑闻证实了我国司法情况自1988年司法危机后已变得极度腐败和偏袒当权者的普遍看法。它已失去了保护人民权利的功用,无法有效维护受害者所应得到的正义。

因此,我们要求撤销导致健康民主政治三权分立制受到严重侵蚀的宪法第121(1)条文的修改,以及成立独立司法委员会以处理委任及擢升法官事宜以恢复我国司法独立。

7.废除新经济政策

新经济政策已偏离于其最初设立之目的,而成为各族执政者中一小撮人积聚财富的工具。绝大多数的马来人难于从此项政策中受惠,而贫困的非马来人也被拒绝于国家援助之外。新经济政策无疑是恶化种族歧视的分化政策。它也违反选贤选能的原则,同时也危害破我国在全球化世界里的竞争力。

因此,我们要求即刻废除新经济政策,并以按照个人需求和能力而非以种族与宗教为基础的扶弱政策取而代之。

8.重组选举制度

马来西亚选举制度存在着严重缺陷,已不能反映人民真正的政治选择。从一个选区到另一个选区之间的巨大选民差额,严重偏离了一人一票的原则。选名册被非法操控而邮寄选票常被执政党调动以巧取豪夺关键选区的胜利。鉴于在野党缺乏在主流媒体发言的管道,因此选民无法享有知情权,进而无法在充足完整的资讯中做出明智的比较和投票决定。选举委员会的操作也偏向执政党。

我们要求通过恢复一人一票的原则、清除选民册的幽灵选民、废除邮寄选票及确保所有政党都得到媒体的平等对待,来改革选举制度。同时,遴选选举委员会成员必须通过公共咨询、在透明化及有公信力的过程中完成。我们要求成立一个皇家调查委员会以改革我国选举制度。

9.捍卫新闻自由

我国的新闻自由受到许多法令的约束,尤其是要求报纸及杂志每年更新出版准证的印刷机器与出版法令。更糟的是,执政党不只拥有许多主流媒体,同时操纵国营媒体,导致人民无法获得资讯以作出明智决定,监督政府、国会以及司法的贪污与滥权。

我们要求废除印刷机器与出版法令以及官方机密法令,同时立法保护资讯自由的
流通。我们要求成立国会特别遴选委员会以检讨其他侵蚀新闻自由的法令。

10.尊重经济、社会与文化权利

大马的经济成长并没有伴随着财富均分的政策。我国的贫富之间的差距一直在扩大,这尤其在马来族群是更加显著。许多人仍然生活于贫困之中,面对食不温饱、居无其屋以及基本设施如水、电、卫生及教育匮乏的情况,特别是在乡村地区及原住民社区。

我们要求尊重经济、社会与文化权利,并设定基本薪金政策以确保所有人民能够享有基本而适当的生活水平。少数民族的宗教、文化和母语应该获得尊重并得以自由发展。华文小学及淡米尔文小学应该根据社群的需要而增建及获得公平的政府拨款。大马是个宪法阐明的世俗国家,回教为官方宗教,但其他宗教应该获得尊重并自由信奉的权利。

11.确保性别平等

女性在马来西亚仍处在社会边缘,特别是在决策的位置上。这些基于宗教至文化标准的歧视必须废除。女性必须受到平等对待。

因此,我们呼吁选民拒绝所有男性至上主义的候选人,如野新(Jasin)和京那峇淡眼(Kinabatangan)选区的前国会议员莫哈末赛尤索夫及彭莫达拉丁。我们也要求在各个领域及决策位置上都能有同等的女性代表以及男女在法律前获得平等对待。

12.保护环境

政府妄顾社会成本、盲目追求经济发展的发展模式,已经严重地污染了河流、海洋、地下水源以及破坏森林。受到政府保护的国产车工业不只在都市引起塞车问题,使到公共交通系统的发展萎靡,同时也释放了大量的废气,助长了全球暖化的危机。

我们呼吁设下严峻的环境保护法令以保护我国的河流、海洋及森林,确保人民拥有干净的水源及清新的空气。有效率、简易及收费合理的公共交通系统应在城市规划中获优先考量,以避免人民过于依赖私人交通工具。

我们力促所有候选人及政党支持这些人权诉求。

我们也呼吁所有选民支持符合以上12项人权诉求的候选人和政党,并抵制任何拒绝支持这12项人权诉求的候选人和政党。

请投票改革这个国家!为更好的马来西亚做出明智选择!

祝马来西亚生日快乐

今天9月16日,马来西亚成立44周年。

我还没有看报纸,不知道今天是否有高官显要会在这特别的日子,为马来西亚献上一些祝福语。

我们不能怪沙巴和砂拉越的朋友对于中央政府不满,因此朋友们对于我们这些住在半岛的朋友不会有太好的影响。我们的政府需要想的是,如果我们真的把他们当成国家的一分子,我们的政府是否已经尽力去照顾他们了。而不是刻意的忽略他们,甚至忘记9月16日才是马来西亚成立的日子。

昨天,因为需要工作,我错过了在吉隆坡独立广场举办的游行。

还好,当今大马有关于该项活动的报导

“50:44”不一样的国庆游行
百人疾呼捍卫独立归还民主


明日是马来西亚的成立日 ,逾百名从南到北 ,包括来自东马的民间人士今日响应由非政府组织组成的“50:44大马独立庆典”联盟的号召 ,聚集在吉隆坡的独立广场举行一场人民游行,高呼要求归还独立、人权及民主的口号。

与8月31日政府主办的“辉煌大马50”歌舞升平式庆典不同,参与者在集会和游行过程中,纷纷高举写着“没有土地,没有文化;没有土地,没有生命!”、“我们居住的土著风俗土地(NCR)是下一代子孙的土地”、“不要只是维护发展商”、“食水是我们的权力”的布条和纸牌,并一起高喊“竖立独立精神!还回人民权力!恢复民主”口号,彰显基层人民的长期诉求。

这场“人民游行”活动的出席者,包括木屋区居民、公民社会组织活跃分子、沙巴及砂拉越州民以及原住民。他们当中更多许多人身穿本身的民族服装出席游行,现场气氛热闹。参与者是先聚集在独立广场,然后才浩浩荡荡地游行到中央市集(Central Market),一起欣赏由民间歌舞团体所呈现的演唱会。

这些民间人士在过去的10天内,皆积极参与了“50:44大马独立庆典”在中央市集所主办的的各种讨论、文化以及剧场表演以及艺术展览活动。

“50:44大马独立庆典”是由30个公民组织组成的联盟,旨在记忆基层人民贡献与斗争的主题下,欢庆独立50年以及马来西亚成立44年,并发布“50:44马来西亚独立:记忆共筑这个国家的人们”宣言。

在集会当中,主办当局也刻意邀请来自基层人民的代表发布他们对独立的看法,与政府庆典只突出高官显要的作风互别苗头。

市民控诉贫穷和木屋问题依旧

来自砂拉越的纽尔申嘉内(Nelson Janel)表示,所有大马公民都享有平等权利,因此独立的成果不应只是掌控权力的精英所独享。 面对逼迁命运的吉隆坡市民叶亚林就控诉本身的命运,表示国家虽然已经独立多年,但是贫穷和木屋区的问题仍然无法获得根除。他们被逼从一个长屋迁移至一个长屋,发展商虽允诺提供永久房屋,但是却从来不曾获得实现。

至于居住在士林河的原住民卡林本嘉(Karim A/L Punggah)指出,如果原住民不能和马来人、华人和印度人享有平起平坐的待遇,这将意味着国家从来没有享有真正的独立。

东马及外劳成为被遗忘的一群

来自沙巴的罗丝则感谢主办者的邀请,让沙巴人民也能一起来庆祝的国庆日。 “马来西亚已经成立44年,但是沙巴人民却感到被边缘化。国庆日一直以来都是在这里(马来半岛)庆祝,我们却是被遗忘的一群。” 大马人权协会的艾丽丝则认为,国庆日并不只是属于大马公民的佳节,也应该是属于所有曾为大马建国所付出血汉的外劳的。

“50:44大马独立庆典”也在集会中呈交一份备忘录给代表国会反对党领袖林吉祥的士布爹国会议员郭素沁,郭素沁表示将会把有关的备忘录带上国会。虽然主办单位也曾邀请首相署派遣官员出席接领备忘录,不过有关官员却迟迟不见踪影。

我很喜欢Alice Nah说的国庆日不只是属于马来西亚的公民,也应该属于曾为马来西亚建过所付出血汗、血泪的外劳。

我们不应该忘记他们,我们很多宏伟的建筑物、地标,如果没有他们流下的血汗,是做不出来的。包括我们的Twin Tower, KL Tower, Putra Jaya, KLIA ... 因此不要把他们当成犯人来对待 -- 不要忘记,我们都曾经是外来移民。

我们必须记得我们这个国家是在9月16日成立的,因此在考虑庆典仪式的时候,我们必须记得还有两个州 -- 而不是政府一味的剥削他们的天然资源,然后刻意遗忘 --

国内事务部部长 !! 我为你感到羞耻!!

9月10日进行的国会会议,竟然有一则这样的消息。

我们的国内事务部(Home Ministry)尊贵的部长Home Affairs Minister Datuk Seri Radzi Sheikh Ahmad,在一项关于RELA的询问,竟然说 "There have been no complaints about RELA"

Jawapan Kementerian Hal Ehwal Dalam Negeri Mengenai Penyalahgunaan Kuasa Anggota RELA Adalah Tidak Bertanggungjawab

Saya ingin merujuk kepada soalan Parlimen lisan yang saya tanya pada 10 September 2007. Soalan dan jawapan adalah seperti berikut:

Puan Teresa Kok Suh Sim [Seputeh] minta MENTERI HAL EHWAL DALAM NEGERI menyatakan bilangan aduan yang diterima berkenaan dengan anggota RELA yang melakukan kesalahan semasa menjalankan operasi pengusiran Pendatang Tanpa Izin. Berapakah di antara mereka telah pun didakwa di mahkamah dan berapakah dijatuhkan hukuman oleh Mahkamah.

JAWAPAN
Tuan Yang Di Pertua,
Untuk makluman Ahli yang Berhormat, setakat ini tidak ada aduan rasmi yang diterima berkenaan dengan anggota RELA yang melakukan kesalahan semasa menjalankan operasi. Walaubagaimanapun aduan-aduan yang diterima hanyalah dibuat secara umum melalui akhbar-akhbar yang mendakwa bahawa anggota-anggota RELA bertindak secara kasar, mengambil harta milik Pendatang Asing Tanpa Izin (PATI) dan sebagainya semasa operasi.
Setakat ini tiada seorang pun anggota RELA yang didakwa di mahkamah atas kes-kes kesalahan semasa menjalankan operasi.

Saya merasa amat hairan terhadap jawapan yang diberi oleh pihak Kementerian Hal Ehwal Dalam Negeri ke atas soalan lisan saya, di mana pihak kementerian tidak menerima sebarang aduan tentang penyalahgunaan kuasa anggota RELA semasa menjalankan operasi, dan kementerian malah berkata bahawa tiada seorang pun anggota RELA yang di dakwa di mahkamah atas kes-kes kesalahan semasa menjalankan operasi.

Jawapan ini adalah amat tidak bertanggungjawab kerana ia menunjukkan pihak kementerian cuba menutup sebelah mata ke atas penyalahgunaan kuasa yang dilakukan oleh anggota-anggota RELA. Segelintir daripada mereka malah berlagak seperti penyamun, perompak dan perogol pada waktu menjalankan tugas.

Di sini saya ingin menyenaraikan kes-kes jenayah yang dilakukan oleh anggota RELA yang disiarkan dalam akhbar semasa menjalankan operasi:

1. Pada 30 Disember 2006, anggota RELA M Suresh (umur 20 tahun) , dan Norirwanshah Mat Nor (umur 21 tahun) merogol seorang gadis berusia 14 tahun di tandas awam di Taman Tasik, seksen 14, Shah Alam. Kedua-dua anggota RELA ini didakwa di Mahkamah Seksyen Shah Alam pada 28 Feb, 2007. ( Utusan Malaysia, Feb 28, 2007)

2. Pada 17 April 2007, 10 anggota RELA yang berpakaian seragam telah pecah masuk ke rumah asrama pekerja asing di Taman Botani dan Taman Soon Choon. Mereka telah merompak barangan bernilai RM 1,800 dengan senjata api. Ketua Polis Daerah Ipoh, ACP Jalaluddin Ibrahim kemudian mendakwa anggota RELA ke Mahkamah di bawah Kanun Keseksaan 395 atas kesalahan samun berkumpulan.
Polis juga mendapati dua daripada 10 anggota RELA berkenaan mempunyai kes jenayah dan pernah didakwa di bawah Kanun Keseksaan 379 (kecurian) sebelum ini. (Utusan Malaysia April 17, 2007)

3. Pada 4 April 2007, jam 10:30 pagi, 80 anggota RELA telah menyerbu pasar pagi Pudu. Mereka telah menangkap 200 pekerja asing, termasuk mereka yang mempunyai permit kerja 18 pemegang dokumen UNHCR. ( China Press April 4 , 2007)

4. Pada 10 April 2007, 8 orang anggota RELA mengambil makanan dan minuman tanpa membayar di Restoran Golden Seafood di Tampoi, Gemas, Negeri Sembilan. Salah seorang daripada mereka malah mencabuli penghormatan seorang pelayan perempuan. Anggota RELA tersebut telah menahan 3 orang pekerja asing yang mempunyai permit kerja. Majikan restoran tersebut kemudian menghubungi balai polis dan imigresen Seremban tetapi tidak dapat mengesan pekerja asing mereka tersebut. ( Oriental Daily 10 April, 2007)

5. Pada April 2007, seorang anggota RELA melarikan seorang pembantu rumah wanita Indonesia. Beliau kemudian merogolnya sehingga dia berhamil. Tangan dan kaki wanita itu diikat selama satu bulan di sebuah rumah kosong. Mangsa rogol ini masih di bawah perlindungan di Kedutaan Indonesia.(Malasyiakini Spetember 7, 2007)

6. Pada 16 Feb 2007, 20 anggota RELA membuat serbuan di Medan Selera Cahaya dan menahan pekerja perempuan Indonesia. Majikan mereka terpaksa membayar wang rasuah RM2,000 untuk membebaskan pekerja mereka. Kes ini juga ditegur oleh YB Dato’ Tan Chai Hoe, Timbalan Menteri Hal Ehwal Dalam Negeri. Kes-kes tersebut merupakan sebahagian kecil daripada jenayah dan salahlaku anggota RELA yang telah disiarkan dalam media. Pihak Kementerian Hal Ehwal Dalam Negeri tidak harus menutup mata dan mengendahkan kesemua penyalahgunaan kuasa yang dilakukan oleh anggota RELA yang telah disiarkan dalam media tanpa mengambil apa-apa tindakan.

Walaupun pihak yang terlibat tidak membuat aduan kepada pihak Kementerian Hal Ehwal Dalam Negeri, pihak Kementerian tidak harus menganggap bahawa RELA tidak melakukan apa-apa penyalahgunaan kuasa semasa dan tidak mengambil tindakan terhadap anggota RELA yang melakukan jenayah semasa menjalankan operasi mereka.

Jawapan YB Menteri tesebut sebenarnya adalah memesongkan Dewan Rakyat dan ini merupakan kesalahan dalam Peraturan Mesyuarat Dewan Rakyat.

Akhirnya, saya juga ingin menyuarakan kebimbangan ke atas Rang Undang-Undang RELA yang dikatakan akan dibentangkan di Dewan Rakyat sebelum ini. Apakah rang undang-undang ini akan memberi lebih ruang kepada anggota RELA untuk melakukan jenayah semasa menjalankan tugas?

Saya ingin menyeru Menteri Hal Ehwal Dalam Negeri untuk mengadakan rundingan dengan Ahli-Ahli Parlimen, NGO dan orang ramai sebelum membentangkan rang undang-undang tersebut, demi mengelakkan penyalahgunaan kuasa anggota RELA.

从新闻及郭素沁的网站看到这样的消息,我真的感到羞耻!!


至少我知道的是,去年6月Selayang的大逮捕行动,因为很多外来移民、难民被打、被虐待及家里的东西被抢,这是一件大事,还闹到人权委员会(Suhakam)去了。然后去年8月Sepang那次很多难民的住家被RELA的人放火烧掉,还发生RELA连煤气桶也不放过的事,也是闹得很厉害。

这两件事情,SUHAKAM都承诺调查,而且都是被媒体报导过的新闻。

接着是Kampung Barembang的事件,当我们的RELA被发展商聘请来对付那的居民的时候,这件事也曾经被报导过。

除了这一切,还有很多大大小小的事件 -- 我们的RELA早已经享有很大的知名度,到一个国际的非政府组织都发新闻稿谴责RELA

Malaysia: Disband Abusive Volunteer Corps
Government Uses RELA Force on Migrant Workers

(New York, May 9, 2007) – The Malaysian government should immediately take steps to dissolve the People’s Volunteer Corps (Ikatan Relawan Rakyat or RELA), responsible for numerous cases of illegal detentions, unlawful use of force, and extortion, Human Rights Watch said today.

The Malaysian government has authorized almost half a million RELA volunteers to help maintain public order, primarily through the apprehension of undocumented migrant workers, most of whom come to Malaysia to augment Malaysia’s insufficient labor force. In carrying out their duties, RELA volunteers often employ unnecessary force and illegal policing practices. Fully uniformed, armed, and unaccompanied by police or immigration officers, they break into migrant lodgings in the middle of the night without warrants, brutalize inhabitants, extort money, and confiscate cell phones, clothing, jewelry, and household goods, before handcuffing migrants and transporting them to detention camps for “illegal immigrants.”

“The government has set up what’s little more than a vigilante force to target foreigners,” said Brad Adams, Asia director at Human Rights Watch. “Given RELA’s repeated abuses, it should be disbanded right away.”

RELA members have failed to distinguish or deliberately ignored the distinctions between undocumented migrants, and refugees and asylum seekers. At other times, volunteers have refused to recognize a worker’s legitimate immigration status. In an effort to legitimatize their own behavior, the volunteers have been known to deliberately destroy identification cards proving a worker’s right to be in Malaysia.

There have been many examples of unlawful behavior by RELA. Cases from 2007 include:

1. On April 5, RELA members arrested some 20 Burmese refugees and asylum seekers at a market in downtown Kuala Lumpur. At least five had been recognized as refugees by the office of the United Nations High Commissioner for Refugees (UNHCR).
2. In late March, eight members of a RELA team removed belongings amounting to RM 1,800 (approximately US$525) from one dwelling. After police ascertained that at least two of those implicated had stolen before, the full team was detained on robbery charges.
3. On March 8, a RELA officer detained an Indian immigrant with identification certifying his legal status. It took four days for the worker’s employer to obtain his release from a detention camp for illegal immigrants.
4. On March 6 and 7, RELA volunteers, who had come to Kampung Berembang, a village near Kuala Lumpur, supposedly to hand out flyers related to court orders, instead helped a developer evict 50 families and tear down their houses. Several villagers were arrested. The demolition went ahead despite an injunction to desist until a scheduled hearing was held. By helping the developers, RELA volunteers engaged in activities – some were spotted operating bulldozers – well beyond their mandate. In addition, they used excessive force while doing so.
5. On March 2, at 2:30 a.m., 10 RELA volunteers raided a factory in Jenjarom, Selangor state, injuring two Nepalese workers and detaining eight others.
6. On January 28, a RELA raid in Kampung Sungai Merab, Denkil, resulted in the arbitrary arrest of 14 persons recognized by UNHCR as refugees.

“The Malaysian government fans xenophobia through its use of RELA,” said Adams. “By targeting all foreign migrants, Malaysia undermines its espoused pan-Asian ethic.”

According to the 2005 amendment to Malaysia’s Essential Regulations, part of Malaysia’s security legislation, RELA is allowed to arrest an individual or enter and search any premises, public or private, without a search or arrest warrant. The amendment also gives RELA volunteers the right to bear and use firearms, and to demand documents. All that is necessary is authorization to conduct a raid from certain RELA officials, including the director general and deputy director general of RELA and other RELA officers appointed by the home affairs minister.

The 2005 amendment also gives effective legal immunity to RELA volunteers. Regulation 16 of the act states: “The Public Protection Authorities Act 1948 shall apply to any action, suit, prosecution or proceedings against … RELA … or any member … in respect of any act, neglect or default done or committed by him in good faith or any omission omitted by him in good faith, in such capacity.”

In response to publicized abuses in April 2007, RELA headquarters issued a circular announcing that a raiding team leader would be responsible for conducting body searches on force members before and after raids to ensure they were abiding by the law. To make sure that volunteers do not steal or plant evidence, the team leader is instructed to check that volunteers are not carrying cell phones or weapons and only a limited amount of money. RELA officials have also responded to complaints by announcing new training procedures.

“RELA’s behavior has embarrassed the government into announcing some minor reforms,” said Adams. “But tinkering with raiding procedures or upgrading training will not get to the fundamental issue, which is that RELA should be disbanded. Malaysia has plenty of professional law enforcement bodies.”

According to Malaysia’s Home Ministry, the role of RELA, which dates back to 1972, is “to help maintain security in the country and the well-being of the people.” It is used as the eyes and ears of the government, to collect information for government agencies such as the police, customs, and immigration on threats to security, to do security patrolling to prevent crime, and, when necessary, to carry out citizens’ arrests. The 2005 amendment ceded more power to RELA by permitting it, “where it has reasonable belief that any person is a terrorist, undesirable person, illegal immigrant or an occupier, to stop that person in order to make all such inquiries or to require the production of all such documents or other things as the competent authority may consider necessary.”

我们的国内事务部的部长的英文水准太差了?还是他的眼睛瞎了,耳朵聋了?

我突然可以理解为什么我们的RELA可以那么的无法无天,就是因为他们有这样一个部长。

记得5月的时候Suaram发了一个有关RELA的新闻稿,我们的陈财和说没有那么严重,坏苹果只有少数。而RELA的Cheif Director则说Suaram这样的组织应该解散。

不要怪我为什么那愤怒,也不要骂我没有好好修心。
