对不起,比南的孩子们

突然,很想念比南的孩子们。

不管是我在中心遇过的那两个孩子们,还是我在比南的村子遇过的孩子们,突然,真的很想念她们。

今天的你们还好吗?你们的生活过得怎么样了?

最近,因为星洲刊登了一些关于比南的文章,我之前在当今大马写的文章,被我重新在面子书张贴,引起了一些思念。

昨天,我的砂拉越的朋友传了2008年马来西亚人权委员会的一份报告 --- 关于比南的妇女、孩子被性侵犯的部分。

看了这分报告,我居然没有丝毫愤怒,我只感觉到深深的悲哀。

(b) Alleged Rape of Penan Women and School Girls


In the last quarter of the year, a foreign non-governmental organization (NGO) – the Bruno Manser Foundation – reported that Penan women and school children were allegedly being sexually abused and raped by loggers in Ulu Baram. This had resulted in a sense of insecurity and fear in the Penan Community. Some survivors were said to have become pregnant and, consequently, ostracized by their community.


SUHAKAM, through its office in Kuching, contacted local NGOs to obtain more details. Meetings were then held with the State Director of Education and the office of the Commissioner of Police.


The Education Department said it had completed its investigation into the alleged rape of a student.


However, it was not able to gain direct access to her. The secondary information gathered was

therefore inconclusive.


On Nov 20, SUHAKAM held a meeting with the State Assistant Commissioner of Police and was told that an investigation had been carried out in early October. The Police questioned 57 witnesses and visited Long Loteng, Long Kevok, Long Kawi, Long Pakan, Long Item, Long Latih, Long Lama, Long Bedian and Long Belok. Available Police records in the Baram District from 1995 showed that, of 11 rape reports, one involved a member of the Penan Community.


In sofar as the more recent allegations were concerned, the Police investigations indicated that one complainant had married the alleged perpetrator, who had been supporting her. Another complainant apparently did not know the suspect(s) and was uncertain as to when and where the alleged incident had taken place. The Police also said they had experienced difficulty in contacting witnesses from the NGO concerned.


SUHAKAM will continue to engage NGOs, the Police, relevant government agencies and the Penan Community to ascertain the validity of these reports. The Commission had planned to carry out its own investigations, but was forced to reschedule its visits due to adverse weather conditions. There was also a possibility that members of the Community would be reluctant to divulge information in view of the massive publicity the cases have generated.

(e) Right to Security

Indigenous communities have complained of harassment and intimidation by employees of private enterprises. The Police have also been accused of bias in dealing with such complaints, and of failure to conduct effective investigations into reports of harassment, death under suspicious conditions and rape.

SUHAKAM held a meeting with the Police and Education Department in the State over the alleged sexual abuse of Penan women and students by workers in timber camps. The Commission is of the opinion that the Police and the relevant agencies have taken the appropriate action in trying to bring the perpetrators to justice. SUHAKAM understands the difficulties faced by the authorities in trying to obtain evidence that will stand up in Court. It is also of the opinion that the underlying factors that expose the communities to the risk of sexual abuse need to be addressed.

当我们的州政府是那么紧密的与大集团结合;当我们的政、商、警都相互的扣在一起;当我们本来应该独立的人权委员会变成政府的爪牙,直接向政府(非国会)负责,这就是我们必须付出的代价 --

弱势群体的声音,就会继续的让我们变得看不到、听不到、感觉不到。

我们有耳朵,但是我们不愿意去聆听他们的声音,当他们发出求助的声音,我们变成聋子。

我们有眼睛,但是我们不愿意去看到他们面对的状况,当他们用求助、无助的眼神看着我们,我们都变成瞎子。

我们有感觉,但是我们不愿意去感觉他们的悲痛,当我们看到他们的苦难,我们都变成毫无感觉的皮囊,唯有这样子,我们才感觉不到。

看到这样的报导,我真的无言以对 。。

我很想反驳,但是我却悲痛的没有反驳的力气。

我只想说,事情过了那么久了,你们到底做了什么?

孩子为什么会和侵犯她的人在一起?他们并没有正式注册,对方甚至有3个老婆,为什么要制造他们是正式夫妻的错觉?孩子是自愿与施暴者在一起,还是她是被逼的?如果没有执法单位的协助,为什么施暴者那么厉害,可以知道孩子什么时候回到砂拉越,回到比南的村子?

孩子忘记被侵犯的细节,不知道侵犯她的人是谁,那就可以表示侵犯她的人不用治罪?寻找这个人,是谁的责任?警察不是通过孩子的婴儿,得到DNA了吗?

只能说,在这国土上,人真的有等级之分的。而做为不与政府、伐木公司合作的比南人,在这些利益集团的眼中,根本就不是人。是这样吗?

我曾经在一篇文章这样说: 比如,有人会说“一定是骗人的啦,不然发生性侵犯的事情的时候,早就报警了”他们不会考虑,报警对比南朋友来说即遥远又昂贵;或者“她们被抛弃而已吗?哎呀小事情啦,到处都有人被臭男人抛弃,吵什么” 。

他们没有顾虑到,伐木工利用比南朋友的纯朴,用欺骗、骗婚的方式来满足他们自私的性欲,是多么卑鄙无耻。很多施暴者知道,比南朋友要寻求帮助是很困难的,因此尽其所能进行剥削,反正他们可以搬迁到其它地方,比南少女根本没有办法找到他们。

这一切,不是你情我愿,这是有规划、系统的性剥削。

幸存者有权寻找她们的幸福

还 有人,当知道有些被性侵犯的少女最后找到比南族的男人,嫁为人妇,过得还可以,就说“反正都嫁人了,就表示其实没有太大的创伤啦,这些都是乱做故事,过于 夸大”。他们不会了解这些少女,尤其是有了孩子的少女,要独自一个人抚养孩子是多么难的事。他们不会相信,很多比南男性都愿意娶这些妇女,因为他们希望照 顾这些被遗弃的人,而且会尊重与爱她们。在比南文化里,相互照顾是理所当然的事。

这些具有偏见者不愿意尊重,幸存者有权继续寻找她们的幸福,即使她们曾被性侵犯和剥削。他们不愿意相信,即使少女们已经有了归属,但是提起那个剥削、侵犯她们的施暴者,她们仍然有很深的愤怒,仍然感到很受创。

除了一般大众,一些高官一再的说“这不是事实”,“他们是负面的非政府组织”,“比南人很容易被利用”,“比南人最会说故事了”。

仍 然重复这些论调的人,如果这样的事情发生在自己的姐姐、妹妹,自己的孩子,自己的朋友的身上,他们仍然会这样评断他们吗?我看不会。当然,针没有刺在自己 的身上,要感觉到痛是很困难的。如果我们依然保持这样的想法,那么相信我,现在发生的罪行,10年、20年后仍然会继续发生。

提到他们没有办法得到非政府组织的协助,在寻找当事人的过程中受到非政府组织的助绕 。。其实,为什么不去想想,为什么这两个那么小的孩子,需要来到吉隆坡报警,如果他们相信那里的警察,她们要这样吗?没有办法相信警察,是谁的错?

性 侵犯会持续发生,是因为种种因素造成,包括毫无节制的伐木公司入侵造成的人为因素。因为政府没有改善当地的公共交通设施,导致他们必须依赖伐木公司的车; 因为政商警的勾结,使他们无法获得法律保护和寻求公道;他们没有办法防止伐木工人继续那么做,因为他们没有办法找到警察帮他们;有时候,因为他们没有身份 证,他们连报警;去社会福利局寻求援助的机会都没有。

我的脑海浮现了这些和这些比南孩子共渡的时光 ---

记得在比南的一个晚上,我们在小小的教堂有一个晚会,我们唱歌、跳舞。而刚好,这些受尽苦难的孩子们的家人坐在一起,看着他们的带着小小的希望的脸孔,我那惭愧的心;看着他们后来被我们这些Sakai邀请一同跳舞,被我们这些Sakai逗笑的一点点的笑容,我的悸动 。。。

我不知道这些孩子们现在怎么样了 。。远在西马的我,跟本就没有办法为她们做更多的事情。

是的,我是辜负了你们的期待的,我想 。。。
